The charge related to an incident on 28 October 2013, when a truck driver, who was standing on his truck tray, was injured while loading steel beams onto the truck and a beam fell on his legs causing a crush injury. The accused was sentenced without conviction to an adjourned undertaking for 2 years to be of good behaviour, with a condition to pay $20,000 to the Court Fund, and ordered to pay costs of $3,763 (Dandenong).
The prosecuted was found guilty of failing to ensure persons other than employees were not exposed to risk, by failing to provide a safe system of work under section 23 of the OHS Act.
